Lot: 1 - 1936 Alexander Phimister Proctor, ''Robert E. Lee and the Confederate Soldier'' Sculpture
NOTE: GRANITE BASE SHOWN IN PICTURES IS NOT INCLUDED WITH THIS LOT!

Restored in 1991, this large monumental sculpture shows General Robert E. Lee riding on his horse, Traveller, slightly ahead of another smaller horse with a young soldier, who represents all Confederate soldiers. The horses appear to be moving at a slow and steady pace. The artist worked in a realistic style that was popular after the Civil War. Proctor studied several photographs of Confederate soldiers to create this composite version of the young soldier’s face, and he also studied many photographs of General Lee to sculpt the face and used Lee’s original uniform as a model for the clothing. General Lee holds his hat in his hand while the soldier behind wears a cap. The sculpture’s estimated weight is 16,500 lbs and measures 9’x5’x12’.

Purchaser agrees to enter into a Bill of Sale with the City that will require that he/she shall not publicly display the item in the City of Dallas, and that the purchaser shall secure this restriction contractually with any subsequent purchaser if the Sculpture is later sold. 

Insurance Requirements:
Prior to removal of the item, the Purchaser (or its Agent) must present a certificate of insurance within 24 hours of notification of a successful bid.  The attached Insurance Requirements are NOT Negotiable.

All paperwork MUST be made out in the company name exactly as it appears on the winning bidder's online account at the time of auction close. If no company name is provided, then it will be listed in the individual name exactly as it appears on the winning bidder's online account at the time of auction close.

The reserve for this auction has been set at $450,000.  Pursuant to the Dallas City Code, Section 2-37.4(g), if the highest bid for the item exceeds $20,000 the sale must be confirmed by the Dallas City Council, and the City will hold the item until the City Council’s confirmation for this sale on 6/12/2019 and when all Terms & Conditions for this sale have been met or agreed to by the purchaser (or its agent).

DALLAS CITY CODE  SEC. 2-37.9.   PURCHASE BY CERTAIN PERSONS PROHIBITED.
The following persons shall not, directly or indirectly, submit a bid for, purchase, or acquire ownership of, personal property sold pursuant to the provisions of this article:
(1) City employees who work in the city manager's office or in the department designated by the city manager to enforce and administer this article.
(2) The person who determines that the property is surplus, obsolete, worn out, or useless.
(3) City officials, as defined in Paragraph 12A-2(24) of the Dallas City Code.
(4) Former city officials, as defined in Paragraph 12A-2(20) of the Dallas City Code, for one year after their term of office ends.

It is the responsibility of the Buyer to have inspected thoroughly the 2017 value appraisal report and to have satisfied himself or herself as to its value and to bid based upon that judgment solely. Any discrepancy with any item description must be dealt directly with the SELLER listed above and not Lone Star Auctioneers, Inc., or its owners, officers, or employees.  All participants hereby agree and accept that neither Lone Star Auctioneers, Inc. nor LoneStarOnline.com will be held responsible for any errors in descriptions or any failure to execute a bid on behalf of any participant(s) for any reason whatsoever. By submitting winning bid(s) on this auction, I acknowledge and accept without recourse that I have purchased the above items at public auction "as is, where is" without warranty or guarantee of any kind. I will not stop payment, dispute or otherwise contest this transaction.

Payment Terms

PAYMENT TERMS:

1. Full and complete payment must be received within 3 business days of auction close by wire transfer.

2. Any bidder(s) who does not pay for his/her online purchases by the deadline shall not be allowed to register or participate in any future auctions conducted by Lone Star Auctioneers, Inc. (live, webcast or online) and the deposit will be forfeited.

3. This sale will require a deposit with Lone Star Auctioneers of $50,000.00 to register as a bidder. Deposit will be refunded by wire transfer if your bid is not the winning bid.

Sales Tax

SALES TAXES
Texas Sales Tax of 8.25% will be collected on all non-titled items unless the items are being purchased for qualified:

  • resale under a valid Texas Sales and Use Tax Permit;
  • non-profit exempt use..

No paid receipts will be issued with sales tax removed until the required information is received in our office by the time of payment.  NO EXCEPTIONS!

NOTE: “A retailer is not required to accept an exemption certificate. If a retailer does not accept an exemption certificate, the purchaser can request a refund of the tax paid directly from the Comptroller if the retailer gives the purchaser an Assignment of Right to Refund.”

Item Removal

Item must be removed from City property within 5 business days of council approval, tentatively scheduled for 6/12/2019. The time of removal will be scheduled with the City.   The winning bidder will be responsible for all costs of removal and transport, and must obtain all required insurance and permits, including any Department of Transportation permits.  If the item is not removed within 5 business days of council approval, or upon agreement from the City for an alternate period of time, the buyer forfeits monies paid and the property reverts to the City of Dallas with no recourse.

PLEASE NOTE: There will be NO ASSISTANCE or EQUIPMENT available from City employees for removal and transportation of items won. Removal is the Purchaser’s responsibility. At time of pick up Purchaser shall provide a copy of the paid receipt and a valid Government issued ID. Individuals without a paid receipt and matching valid ID will not be able to remove the item. No Exceptions! Written authorization must be provided to the seller allowing a person other than the buyer named on the paid receipt to pick up the item.

Auction Terms

Anti Sniping / Dynamic Closing:
Each auction item is scheduled to end at a specific time. However, all LoneStarOnline auctions use an AUTO EXTEND / DYNAMIC CLOSING feature. Thus, bidding will still remain open on any item that receives a bid within the last 5 minutes prior to the scheduled closing time. Time extensions are added in 5 minute intervals to the original auction closing time and to each extension’s closing time when a bid is placed. For example: if an item is scheduled to close at 10:00am, and a bid is placed between 9:55am to 10:00am, the closing time will be extended by 5 minutes until 10:05am. If a bid is placed within that 5 minute interval, then bidding the closing time will extend until 10:10am, etc… Once a 5 minute extension interval has passed without any bids, the auction for the item will close, and the lot will show as COMPLETED in red letters. This means that bids are no longer accepted, and the username showing is the winning bidder. To make sure you see all other bids placed, click the “Refresh” button on your web browser frequently before that item closes and during any extension periods. Your screen may not “auto-refresh,” and you may not see bids placed after yours if you don’t manually refresh.
